Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Scripture First (“we,” “us,” or “our”) for the Scripture First iOS application (the “App”) and the related website at downloadscripturefirst.com (the “Site”). They are not a substitute for legal advice. If you do not agree, do not use the App or Site. These Terms include a binding arbitration agreement and class action waiver in the “Governing Law and Disputes” section that affect how disputes are resolved.
Acceptance of Terms
By downloading, installing, or using the App, or by using the Site (including joining the waitlist), you agree to these Terms and to our Privacy Policy.
Eligibility
The App and Site are intended for users 13 years of age or older. By using them, you represent that you are at least 13. If you are under the age of majority where you live (typically 18), you may use the App or Site only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. You also represent that you are not located in, under the control of, or a national or resident of any country or on any list for which U.S. law prohibits providing the App or Site.
Description of Service
Scripture First is an iOS Bible reading application that can use Apple’s Family Controls frameworks to block apps you choose until you complete a designated Bible reading. Features may include Bible reading in multiple translations, reading plans (including custom plans), temporary unlock windows after reading, an Emergency Open bypass, local highlights, bookmarks, verse notes, streaks and Bible-time tracking, optional AI-assisted verse study, optional email-based accounts, and optional premium subscription features presented through Apple In-App Purchase and Superwall.
App Blocking and Family Controls
Certain features require you to grant Apple Family Controls (Screen Time) authorization on your device. You choose which apps, categories, or web domains to restrict. You are solely responsible for the restrictions you configure and for understanding that blocking may interrupt access to other apps on your device until reading requirements are met or you use an available bypass (such as Emergency Open) or revoke authorization in iOS Settings.
Scripture First’s blocker is designed for individual use on devices you own or control. It is not a parental-control management service for another person’s device unless Apple’s frameworks and your device settings expressly permit that configuration. We are not responsible for missed notifications, missed communications, or other consequences of apps you choose to block.
Optional Accounts
You can use much of the App without creating an account. If you choose to create an account in Settings, you may sign in with an email magic link or with an email and password. By creating an account you confirm that the email address you provide is yours and that you meet the eligibility requirements above.
You may sign out at any time, and you may permanently delete your account from inside the App. Account deletion does not refund any subscription you purchased through Apple and does not delete data already saved on your individual device. Account features may be changed, paused, or discontinued; if we make material changes to account or sync capabilities, we will update these Terms and the Privacy Policy.
Waitlist and Site
If you submit your email on the Site waitlist, you ask us to contact you about Scripture First launch, access codes, and related product updates. Waitlist participation does not guarantee a free trial, offer code, or App Store availability. Any waitlist perk (such as a limited free-access offer code) is subject to the terms shown when the code is issued and to Apple’s rules for redeeming offers.
Subscription Services
Auto-renewable subscriptions: The App may offer subscription options (for example, monthly or annual plans, with or without introductory pricing, free trials, or offer codes). Exact offerings, prices, and trial terms are displayed at purchase time in the App and in App Store Connect.
Subscription terms:
- Subscriptions automatically renew at the same price and duration as the original subscription unless you cancel at least 24 hours before the end of the current period.
- Payment is charged to your Apple ID at confirmation of purchase, and Apple may charge the renewal up to 24 hours before the period ends.
- You can manage or cancel subscriptions in your Apple ID account settings. Turning off auto-renewal is the only way to stop renewal.
- If you cancel, you keep access for the remainder of the paid period; early cancellation does not refund the current period except as required by law or Apple policy.
- Free trial eligibility, offer codes, and forfeiture rules follow Apple’s terms shown at purchase or redemption. If you are eligible for a free trial or promotional period and you purchase a subscription before it ends, the unused portion may be forfeited as described by Apple.
Paywalls: Certain subscription offers may be presented using Superwall. Purchases still go through Apple; Superwall provides presentation and experimentation tooling.
Premium features may include reading plans, app blocking / unlock features, AI-assisted verse study, and related tools, subject to change as the App evolves. Features listed in marketing materials are illustrative; the in-app purchase screen controls.
Free Features and Limits
The App may offer free access to portions of the experience (for example, Bible reading) while gating other features behind an active subscription, trial, or redeemed offer. Free tiers, quotas, and feature availability may change over time.
Payment and Billing
All in-app purchases are processed by Apple. Prices may vary by region or currency. Refund requests are handled by Apple according to Apple’s policies. We do not process card payments directly for App subscriptions.
AI-Generated Content
The App uses artificial intelligence services (including OpenAI models) to generate or assist with verse study content. You acknowledge that:
- AI output is for education and devotion, not professional pastoral counseling, academic certification, medical, legal, or other professional advice.
- AI can be incorrect, incomplete, or reflect limitations of training data; always compare important claims to Scripture and trusted teachers.
- When you use AI features, prompts are sent to OpenAI as described in our Privacy Policy; OpenAI’s terms also apply: OpenAI Terms of Use.
Analytics and Advertising Measurement
The App includes the Meta (Facebook) SDK and may log subscription-related events for measurement and marketing attribution. Use of these tools is described in the Privacy Policy. Apple’s App Tracking Transparency prompt governs certain tracking behaviors on supported devices.
User Conduct
You agree to use the App and Site only for lawful purposes. You may not:
- Use the App or Site in violation of any law or third-party right
- Attempt to interfere with, reverse engineer, or circumvent security, payment, access controls, Family Controls protections, or paywalls
- Use automated means to abuse APIs, paywalls, waitlist forms, or rate limits
- Submit unlawful, harassing, or harmful content through prompts, notes meant to be shared unlawfully, or communications to us
- Misrepresent your identity when contacting us or creating an account
- Redistribute publisher-licensed Bible text outside the personal uses permitted by the applicable license
Content and Intellectual Property
The App’s and Site’s software, design, selection and arrangement of materials, and original text we provide are protected by intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to use the App on Apple-branded devices you own or control, as permitted by Apple’s usage rules, and to use the Site for its intended purposes.
- Bible text and translations: Scripture may be provided offline (for example, the King James Version, which is in the public domain) or through licensors such as API.Bible. Copyrighted translations currently offered include the New King James Version (© Thomas Nelson) and the New Living Translation (© Tyndale House Foundation). You must respect applicable copyright notices shown in the App and not redistribute publisher-licensed text outside personal, private study uses allowed by those licenses.
- Your notes and custom plans: You retain ownership of content you create in the App (such as personal notes and custom reading plans). You grant us a limited license to host, store, and process that content only to the extent technically required to operate features you use.
- AI output: Unless otherwise required by a third-party license, AI-generated content is licensed for your personal, non-commercial use within the App and may not be resold or systematically republished as if it were human-authored scholarly work without appropriate disclosure.
Third-Party Materials and Links
The App or Site may reference or link to third-party sites, APIs, or documents. We do not control and are not responsible for third-party content or practices.
Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App and Site are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App or Site will be uninterrupted, error-free, or free of harmful components, or that Family Controls blocking, unlocks, notifications, or AI features will meet your expectations in every circumstance.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Scripture First or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to use) the App or Site — including consequences of apps you choose to block — even if we have been advised of the possibility of such damages. Our aggregate liability for claims arising out of or related to the App or Site will not exceed the greater of (a) the total amount you paid to Apple for Scripture First subscriptions during the twelve months before the claim or (b) fifty U.S. dollars (US$50), except where prohibited by law.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.
Indemnity
You will defend, indemnify, and hold harmless Scripture First and its personnel from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the App or Site, your content, the restrictions you configure, or your violation of these Terms, except to the extent caused by our willful misconduct.
Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor conditions, internet or telecommunications failures, outages of third-party services we rely on (such as Apple, OpenAI, Supabase, Meta, Superwall, Resend, Cloudflare, or API.Bible), or other similar events.
Privacy
Our Privacy Policy explains how information is collected, used, and shared.
Export Controls
The App and any related software may be subject to U.S. export control and economic sanctions laws. You agree that you will not use, export, re-export, or transfer the App in violation of those laws, and you represent that you are not located in, and are not a national or resident of, any country subject to a comprehensive U.S. embargo, and that you are not on any U.S. government list of restricted or prohibited parties.
Changes to Terms
We may modify these Terms from time to time. We will post the updated Terms and change the “Last updated” date. Continued use after the effective date constitutes acceptance, except where applicable law requires additional notice or consent.
Termination
We may suspend or terminate access to the App or Site if we reasonably believe you violated these Terms or created risk or legal exposure for us. You may stop using the App or Site at any time. Provisions that by their nature should survive (including disclaimers, limitations of liability, indemnity, and governing law) will survive termination.
Governing Law and Disputes
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law rules. Nothing in these Terms limits any non-waivable rights you may have under the consumer protection laws of the country or state where you live.
Informal resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at scripturefirstapp@gmail.com. If we cannot resolve the dispute within 60 days, either of us may proceed as described below.
Binding arbitration. Except for the carve-outs below, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Oregon, United States, or, at your election if you are a consumer covered by AAA’s Consumer Rules, in the U.S. county where you live, or by phone or video. Judgment on the award may be entered in any court with jurisdiction.
Class action waiver. You and we each agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding. If this class action waiver is found unenforceable, then the entirety of the arbitration agreement will be null and void, but the remainder of these Terms will remain in effect.
Carve-outs. Either party may bring a claim in small claims court if it qualifies, and either party may seek injunctive or equitable relief in court for actual or threatened infringement or misuse of intellectual property or unauthorized access to the App or Site. To the extent any claim must be heard in court, you and we consent to the exclusive jurisdiction of the state and federal courts located in Marion County, Oregon, and waive objections based on inconvenient forum.
Opt-out. You may opt out of this arbitration agreement and class action waiver by sending written notice to scripturefirstapp@gmail.com within 30 days of first accepting these Terms. Your notice must include your name, the email associated with your account (if any), and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.
Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while reflecting the original intent. These Terms, together with our Privacy Policy and any additional terms presented at purchase or in the App, constitute the entire agreement between you and us regarding the App and Site and supersede any prior agreements or understandings on the subject.
Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, financing, or sale of assets. Any attempted assignment in violation of this section is void.
Apple App Store Terms
If you obtained the App from the Apple App Store, you acknowledge that:
- These Terms are between you and Scripture First, not Apple.
- Apple is not responsible for the App or its content, maintenance, or support.
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price to the maximum extent permitted by Apple’s policies; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of a third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Scripture First, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim to the extent required by these Terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the provisions addressing Apple against you.
